Relief from Deportation

If our client is found to be deportable-removable, we determine the forms of relief which may be available, including: 

  • Cancellation of removal
  • Asylum
  • Withholding of removal
  • Deferral under the Convention Against Torture
  • Adjustment of status
  • Waivers of inadmissibility
  • Special Rule Cancellation of Removal, under the NACARA

Next, working closely with our client and their family, we prepare comprehensive, indexed, applications for relief from deportation for  the Judge’s consideration.  These applications are of critical importance: they must comply with the requirements of the statutes; familiarize the Judge with our client, and show our client deserves to be granted relief.  

Prior to trial, we meet with our clients, and their witnesses.  We explain how the trial works, and review their testimony, so they know what to expect, and how to stay on point.  Our firm has gained a reputation for winning even the most difficult cases – which is why our former clients, other attorneys, Judges, religious and community leaders, all refer persons in need of skilled representation to our firm.   And while we have a high rate of success in the Immigration Courts, at the trial level, we have also won many appeals before the Board of Immigration Appeals, and the United States Court of Appeals for the Second Circuit.

Our attorneys keep up to date on new decisions by the Board of Immigration Appeals and the Federal Courts. We use these precedent decisions as the tools for winning our clients’ cases.  We often formulate an advance novel legal arguments that have been accepted by the Immigration Courts.

In other cases, especially where our clients’ convictions are older, and we can show rehabilitation, we have been able to convince the government to dismissing the proceedings against our clients, as a matter of prosecutorial discretion.  

Unfortunately sometimes a client may have a trial before an unfair judge, one who does not follow the law. Even if order deported, a non-citizen has an absolute right to appeal to the Board of Immigration Appeals, and then to the federal courts to ensure their rights are respected. We have successfully handled many immigration appeals. 

Vacating Convictions to avoid Deportation

When all avenues for relief in the Immigration Court are closed, our experience in criminal defense and post-conviction enables us to return to the criminal court and vacate our clients’ convictions.  Some of the grounds we raise include ineffective assistance of counsel and failure to advise the client of the immigration consequences of a given plea, pursuant to Padilla v. Kentucky.  We have successfully vacated many of our clients’ convictions and so helped them to avoid being  deported.
