Moving Violations
In most instances we can substantially reduce the violations charged and points assessed. We often obtain the dismissal of some, or all, of the charges against our clients, or negotiate a plea to a non-moving violation. Our office has successfully defended thousands of traffic violations.
People who rely upon their commercial driver’s license (“CDL”) to earn a living, rely upon us to defend charges such as driving with a suspended or revoked license, driving intoxicated, vehicular manslaughter or assault, leaving the scene of an accident, speeding, red light, overweight operation of a vehicle, failing to signal, tailgating, cell phone use, and uninsured or unregistered operation. Our attorneys are familiar with the intricacies of the criminal and traffic laws, and can often resolve traffic violations, even multiple speeding violations, in a way which avoids the suspension or revocation of our client’s license. If a favorable plea cannot be negotiated, we are ready and willing to take your case to trial.
Defense of Vehicle and Traffic related charges

The New York State Department of Motor Vehicles (DMV) issues points on your license for certain types of traffic violation convictions, and more is definitely not better. New York’s point system is designed to identify drivers who commit many traffic violations in a short period of time. In other words: dangerous drivers. While we sometimes make mistakes and one or two minor offenses aren’t usually enough for the DMV to suspend or revoke your license, several traffic violations or a single “serious” traffic offenseraise a red flag and can result in automatic suspension or revocation of your license. This can result in civil penalties up to $750 depending on the reason for the suspension and payments, as well as driver responsibility fees and application fees.
Insurance Consequences
The DMV isn’t the only organization you need to worry about. Not only do you face court fines and DMV assessment fees for moving violations, but insurance companies have their own independent point systems and can increase your premiums based on your driving record. Insurers check your record when they renew your policy, and sometimes all it takes is one conviction for a moving violation to raise your rates. In some cases, you risk your insurance cancelled outright if the co0mpany determines your driving habits make you an undesirable risk. At that point, maintain insurance coverage would be extremely expensive, and driving without insurance is illegal and carries significant penalties in New York (Including losing your license for at least one year).
Suspension and Revocation
If you receive 11 points for moving violations in an 18 month period, or you are convicted of a single “serious” traffic violation, the DMV may suspend or revoke your license. Points are assessed according to the date of the offense, not the date of conviction.
